(Conformation puppy) health Contract

We guarantee this puppy to be in good health, to the best of our knowledge. Prior to this day this puppy has been examined by a veterinarian at least twice and no defects have been found. To keep this gurantee valid, the puppy must be examined by the buyer's lincense veterinarian within 48 hours of receipt of the puppy. If the veterinarian finds the puppy unhealthy, the puppy must be returned to the breeder within 48 hour's, accompanied by a certificate or statement from a veterinarian explaining the problem or condition. The breeder assumes no responsibility for charges incurred by the buyer for this service. The buyer agrees that the breeder would never knowingly sell a sick puppy and could not have been aware of any illness or defects and will not be held responsible for such. The breeder will give buyer a replacement puppy, of equal value. If one is not available at the time, the buyer will be put at the top of the list to receive a puppy from the next litter.

If the puppy is found to have one of the genetic health problems as listed below,  at its initial veterinary visit and the buyer opts to treat the puppy instead of exchangeing it for a replacement puppy the breeder will not be held responsible for any expense incurred or the death of the puppy. Common viruses, common parasites, fleas, ticks, worms, coccidian, parvo, kennel cough, corona virus, distemper, mange, etc. Are not cause for replacement, as they are not genetic related.

The breeder does not guarantee that when puppy turns 6 month's  or older it'll be show quality, The buyer understands that the puppy is a sound representative of its breed, to be used primarily as a family companion. Additionally, this puppy has been selected by the seller as a conformation prospect. Specifically, to the best of seller’s knowledge, as of this date, the puppy is representative of the breed as a conformation show prospect and there is no evidence of disqualifying faults as defined in the Doberman Pincher Club Of America Association Standard, recognized and adopted by the American Kennel Club and has not been artificially presented nor surgically altered. Further, seller warrants at the time of Ownership Transfer, the puppy is within both the AKC and FCI size charts and seller expects the puppy will be within size when fully matured; however, buyer acknowledges seller does not warranty mature size, nor conformation points when matured as defined in the Doberman Pincher Standard or suitable for breeding nor does the breeder guarantee color of puppy. The breeder will not be responsible if puppy's ear's do not stand since this is a product of the aftercare of the ears, and the responsibility of the buyer.

The breeder is not responsible for any injury to the puppy after the buyer has taken possession of the puppy. If the puppy dies within 24 months from the time of purchase and it is agreeable of both party's veterinarians that the death was directly due to a hereditary defect, the breeder will replace the puppy once a replacement puppy is available. This will only happen after an autopsy is preformed on the puppy, and the breeder's vet is in agreement with the findings. The autopsy must be performed within 72 hours of the puppy's death and will be done at the buyer's expense. A copy of the autopsy report as well as reports of any tests or treatments performed by the buyer's veterinarian must be supplied within 72 hour's of the puppy's death, or as soon as it becomes available. In the event that the puppy's death is a result of abuse or negligent treatment, this guarantee will not apply and the breeder will not replace the puppy. Any health claims must be submitted with proof and documentation by lincense professionals.

  The puppy is guaranteed to be FREE of hip dysplasia for 24 month's when raised on approved feed (receipt will be required for verification): hip problems must be verified an graded as "poor" by the OFA and have active lameness. The puppy is guaranteed to be FREE of all genetic cardiac problems for 24 month's; cardiac problems must be verified by a cardiologist an confirmed with an EKG, ECHO, or Holter Monitor or ProBNP blood test. The breeder will in no way be held responsible for vwd or for testing or veterinarian bills. The breeder will not be responsible for any shipping or travel fees, and replacement puppy will be given when available.

   NO REFUNDS OF ANY MONIES WILL BE GIVEN UNDER ANY CIRCUMSTANCES, FOR ANY REASON. BREEDER WILL OFFER A REPLACEMENT PUPPY IF CONDITIONS THAT COMPLY WITH THIS AGREEMENT ARE MET AND KEPT.

The breeder STRONGLY suggest that the buyer attends obedience classes with the puppy and a pack leader groundwork program. The buyer agrees that the puppy will be provided proper and adequate socialization. The buyer also agrees that the puppy will not be mistreated or neglected in any way or used in any activities or sports that would be a danger to the puppy. Good and reasonable care will be provided to this puppy. Premium puppy and dog food will be provided and proper guidlines will be followed to avoid deformities in the skeleton growth of the puppy. Puppy will be provided fresh water daily, daily exercise an sunlight, kept up to date on heart guard medications, deworming, vaccinations, daily supplements an routine veterinarian exams. The puppy will not be subjected to any abuse or neglected as determined by a competent, certified veterinarian and/or behavior specialist.

   The puppy will not be spayed or neutered before 24 months of age. The puppy will NOT be bred before 24 month's of age. The dog will not be altered in anyway not in compliance with AKC standard's for this breed. Doing any of these thing's will immediately VOID this agreement. Puppy will never be sold, given or rehomed to any puppy mill's, commercial breeders, pet stores or anyone associated in ANY WAY with DOG FIGHTING. If buyer decides to sale or rehome puppy, the breeder will be given FIRST right to purchase or take the dog back. Buyer agrees that any violations to these terms can and will result in breeder taking immediate possession of the puppy, without any compensations of the buyer.

   Female dogs will not be bred more than once, every other year, and never past the age of six years of age. Any and all offspring from the puppy will NOT be sold to puppy mills, commercial breeders, pet stores or anyone associated in ANY way with DOG FIGHTING.

     The buyer agrees to indemnify an hold harmless the breeder from any and all loss, damages, expenses, charges or claims caused by the puppy. The buyer acknowledges that it is their responsibility to train and care for the puppy and the breeder is not to be held responsible for any behavioral, social or mental issues if they arise. The buyer acknowledges that owning a dog, specifically of this breed, can have potential risks, such as but not limited to: the dog can bite or scratch, trip people, may knock over children, destroy property, fight injure other animal's. The buyer acknowledges that the breeder cannot predict weather the puppy will be suitable for the buyer's lifestyle and household.

   This agreement supersedes all prior discussions, representations, warranties and agreements from either party, except for what is directly written in this agreement. The buyer acknowledges that the breeder has not made any other promises or agreements, written or oral and will not be held accountable for such. This agreement may only be amended by written instrument, signed by both the buyer an breeder. Any remedy provided in this agreement is in addition to any an all other remedies provided by law. This agreement shall be governed by an construed in accordance with the State of Taxas, and any legal matters will be settled in Dallas, Texas.
