(Show/ performance co-owner contract)

This document will serve as a legal and binding contract between Kimberly Lane, owner of Jella Pride dobermann's kennel, hereinafter called the "breeder/owner". and_____________. Hereinafter called the "co-owner". This contract will remain in effect until such time as it has been fulfilled or terminated by the agreement of both parties.

The above described Jella Pride dobermann's kennel has been transferred and will reside with the co-owner. The ownership and additional paperwork will carry the breeder/owner's name until the co-ownership contract has been fulfilled.

Co-owner responsibilities

1. The co-owner must take full responsibility for said dog/bitch's care. All vaccination records must be available for breeder/owner's inspection. The dog/bitch must also have all regular boosters and immunizations (appropriate to your lifestyle and regional area).

2. The co-owner must give the dog/bitch proper nutritional concern, referring to Jella pride  dobermann's kennel nutrition and socialization guidelines and agreement for nutritional specifics further, contact your veterinarian and breeder/owner for proper feeding and supplementation.

3. In the event of accident or injury, the co-owner must immediately inform the breeder/owner of dog/bitch's condition. Any necessary veterinarian or hospital charges are the responsibility of the co-owner.

4. The co-owner must agree to give the dog/bitch proper socialization for mental health and stability. The dog/bitch must be trained in agreed upon venue. The dog/bitch must get a CGC ( canine good citizenship) title through an AKC training club or a place that offers CGC. The dog/bitch has to get a AKC performance or a companion title if the dog is not going to be shown in conformation events. If said dog/bitch is going to be shown in confirmation then dog has to get a title in either one of the venues (AKC,UKC or IABCA) For a confirmation title. All shows, performance and companion venue fees and extra are the co-owner responsibility, breeder/owner does not pay.

5. Dog/bitch must be fully health tested by time dog/bitch is 24 months old or before dog/bitch is transferred fully into co-owner name. Health test includes ,DNA dcm,vwd and etc, For the breed standard. Once said dog/bitch is fully healthy tested with required health test and has a CGC along with one of the above venue titles the dog/bitch will be transferred fully in co-owner name. 

6. Dog/bitch is not to be bred before said dog/bitch is titled and health test or before the dog/bitch is fully transferred into co-owner name.

 

Legalities

In the event the dog/bitch is lost, killed or injured seriously , so as to render dog/bitch unable to show or compete in events, in consequence of any co-owner negligence, or that of his/her agents or employees, the sum of full value price as originally stated on first page of this agreement, and is to be paid promptly to the breeder/owner as liquidated damages. Further, the breeder/owner shall have the right to repossesse said dog/bitch at no cost to breeder/owner.

2. Should the co-owner find him/her unable or unwilling to fully comply with the terms of this contract, with respect to care for the dog/bitch must be returned to Jella pride  dobermann's kennel forthwith. Failure to return the dog/bitch under these circumstances, the co-owner hereby gives the breeder/owner the following options.

A: breeder/owner's agent may take possession of the dog/bitch from the co-owner's property, providing the dog/bitch is in good health; and the co-owner signs the dog/bitch back to the breeder/owner, making this contract null and void; or

B: the breeder/ owner can subject the co-owner to liquidated damages in the amount of $15,000.00, all attorney's fees, and the legal cost of bringing this action to enforce the terms of the contract. Should the dog/bitch be spayed/neutered prior to owner fulfilling this dog/bitch co-ownership contract, the co-owner agrees to pay the sum of $10,000.00 to Jella pride dobermann's kennel and all legal fees incurred. Unless imminent health reasons, veterinarian documentation as to the dog/bitch's condition which warrants the need for spaying/neutering being provided to the breeder/owner, and presents/owner providing written consent to spaying/neutering dog/bitch the dog/bitch shall remain intact until fulfilment of this breeding show dog/bitch co-ownership contract.

3. Any litigation shall be executed in the state of Texas, Ellis county, it being the place of origin of this transaction.

4. If any piece of this contract is invalid, the rest of the contract remains valid.
